The CA primary is held in five months.

I was at the Reno Cruz HQ yesterday. The guy in charge is from CA and while he agreed Cruz was unlikely to win the General in CA, he also said the excitement and energy he was seeing from Cruz supporters in CA is like nothing he's ever seen before.

gflight,

That's true.

Yet those numbers are largely based on popular sentiment, which can quickly change.

Most voters aren't yet tuned in. When they do, esp. if Cruz is the nominee on our side, Hillary will get crushed.

If you're a betting man, take Cruz now!

"THERE IS NO WAY THAT THEY WALK AWAY FROM THIS": Hillary Will Be Indicted Says Former U.S. Attorney

By Mark Tapscott

A former U.S. Attorney predicts a Watergate-style showdown in the Department of Justice if Attorney General Loretta Lynch overrules a potential FBI recommendation to indict Democratic presidential candidate Hillary Clinton.

“The [FBI] has so much information about criminal conduct by her and her staff that there is no way that they walk away from this,” Joseph diGenova, formerly the District of Columbia’s U.S. Attorney, told Laura Ingraham in a Tuesday radio interview. “They are going to make a recommendation that people be charged and then Loretta Lynch is going to have the decision of a lifetime.

My perception would be that she is endorsing Bernie.

Feel the Bern....

Three weeks before the leadoff Iowa caucuses, Clinton appears to be changing up her strategy of looking past the Vermont senator, instead going after his record on gun control, taxes, health care and even the Wall Street regulations that have been the core of his insurgent campaign.

Clinton, picking up the endorsement of the Brady Campaign to Prevent Gun Violence, cast Sanders Tuesday as weak on gun control.

Hillary claimed Monday that Sanders would "rip up" ObamaCare and put power in the hands of states. She also came out against the Obama administration’s raids targeting Central American immigrants who entered the U.S. illegally and ignored deportation orders.

Mrs. Clinton’s emails has been determined to be “top secret/SAP.” That designation is usually given to information about “special access programs” — often intelligence-gathering programs and other secret programs run by the Pentagon and the C.I.A. — that are among the government’s most closely guarded secrets.

People with top secret clearance can't access top secret/SAP material without being cleared.

From: Dave G.

Lex,

You are correct in stating that people with top secret clearance can't access top secret/SAP material. But a lot of people toss the term "cleared" around when in reality "cleared" is simply a non-descriptive term that doesn't mean jack in the intel world.

There's a myriad of protocols involved when it comes to the SAP world. It appears Hillary violated quite a few of them.

Hillary Clinton Exposed Human Intelligence Sources -- Our Spies -- In Her Emails, and May Have Cost Their Lives —Ace

To keep Congress and FOIA requests from discovering her own secrets, she chose to imperil the nation's secrets.

Catherine Herridge:

At least one of the emails on Hillary Clinton's private server contained extremely sensitive information identified by an intelligence agency as "HCS-O," which is the code used for reporting on human intelligence sources in ongoing operations, according to two sources not authorized to speak on the record.

Both sources are familiar with the intelligence community inspector general’s January 14 letter to Congress, advising the Oversight committees that intelligence beyond Top Secret -- known as Special Access Program (SAP) -- was identified in the Clinton emails, as well the supporting documents from the affected agencies that owned the information and have final say on classification.

According to a December 2013 policy document released by the Office of the Director of National Intelligence: “The HSC-0 compartment (Operations) is used to protect exceptionally fragile and unique IC (intelligence community) clandestine HUMINT operations and methods that are not intended for dissemination outside of the originating agency.”

...

"There are people’s lives at stake. Certainly in an intel SAP, if you’re talking about sources and methods, there may be one person in the world that would have access to the type of information contained in that SAP,” he said.

So that information is kept under lock and key, because if the target country discovers it, they can figure out pretty quickly who leaked, and either kill the spy, or flip them into feeding us false information.

Either way, we lose a crown jewel of intelligence, and maybe someone loses his or her life. (Maybe the family's killed too.)

But hey! Gotta keep Hillary's emails protected from Congressional oversight and FOIA requests!

So anything goes for the Queen.

L'etat, c'est moi.

Why the Justice Department Won’t Work with the FBI on Clinton’s E-mail Case

From article:

"...In an ordinary case, that would not be a point worth making. The FBI routinely conducts major investigations in collaboration with Justice Department prosecutors — usually from the U.S. attorney’s office in the district where potential crimes occurred. That is because the FBI needs the assistance of a grand jury. The FBI does not have authority even to issue subpoenas, let alone to charge someone with a crime. Only federal prosecutors may issue subpoenas, on the lawful authority of the grand jury. Only prosecutors are empowered to present evidence or propose charges to the grand jury. And the Constitution vests only the grand jury with authority to indict — the formal accusation of a crime. In our system, the FBI can do none of these things.

No Justice Department, no grand jury. No grand jury, no case — period. As a technical matter, no matter how extensively the FBI pokes around on its own, no one can be a subject of a real investigation — i.e., one that can lead to criminal charges — unless and until there is a grand jury. That does not happen until the Justice Department hops on board..."

And the Obama DOJ will--no, has to protect Hillary to protect themselves.

Judicial Watch Releases Independent Counsel Memo Laying Out Criminal Case against Hillary Clinton in Whitewater Land Scandal

‘The Castle Grande transactions were crimes’

Hillary Clinton ‘destroyed’ her personal records

A case of ‘possible obstruction’ of justice

Sources say redacted portions of memoranda contain a draft indictment of Mrs. Clinton

Never-before-published prosecution memos from April 1998 say Clinton’s ‘sworn statements to the RTC, the FDIC, the Senate and the House of Representatives and to OIC … reflected and embodied materially inaccurate stories’

A 4/10/98 OIC memo uses terms ‘crime(s),’ ‘criminal,’ ‘fraudulent,’ ‘misrepresented,’ ‘inaccurate,’ ‘deceive,’ ‘mislead,’ ‘misstatement,’ and ‘concealed’ 27 times in 20 pages to describe actions by Clinton and Whitewater associates

Article concludes:

"Ultimately, as an April 24, 1998, memo suggests, prosecutors were persuaded that a jury would not convict Clinton based upon circumstantial evidence. OIC attorney Paul Rosenzweig wrote:

In a high profile case of this sort, however, I think that some jurors are likely to put OIC to the full measure of proof beyond a reasonable doubt and, in effect, insist that circumstantial evidence is an inferior form of evidence on which they cannot convict. Such a distinction would be “lawless” in a formal sense, as contrary to their jury instructions – but we blink reality if we do not expect this reaction to a primarily circumstantial high profile case.

The prosecutor concluded:

Bottom line: We can anticipate the following: 2% = Rule 29; 18% = Acquittal; 70% =Hung Jury; 10% = Conviction. Not enough in my view.

These new Hillary Clinton prosecution memos are damning and dramatic,” said Judicial Watch President Tom Fitton. “Hillary Clinton’s bank fraud, obstruction, lies, and other fraud began in Arkansas, continued in the White House and actually accelerated because the suicide of her friend Vincent Foster.

The memos suggest that if she weren’t First Lady, she would have been successfully prosecuted in federal court.

As we continue the court fight to get the actual draft indictment of Hillary Clinton we first uncovered in this investigation, Americans would do well to read these memos. If you want to understand the deplorable ethics and corruption at the Clinton State Department, these documents provide important background.”

Links to the documents are at link.

Question to our resident legal expert:

Would any of this be brought up in court if the DOJ indicts Hillary based upon the FBI investigation in the news of late? Maybe as evidence as a pattern of behavior? Or is all of this "water under the dam" and of little import (other than historical)?

In that capacity I was also the Designated Program Manager for a Special Access Program (SAP) like the SAP that Hillary Clinton is alleged to have compromised in the most recent State Department Inspector General report to Congress and which has been widely reported in the news. Here is what I personally know about SAP's and what I can attest to in an unclassified forum:

1. The names of each SAP are themselves classified Top Secret because the information within the SAP are far and above Top Secret.

2. SAP's are so sensitive that even people who have security clearances giving them access to Top Secret Sensitive Compartment Information (TS SCI), an enormously high security clearance level, cannot have access to SAP's unless they receive a special indoctrination into the SAP based on an operational "must know" that exceeds all other "need to know" standards.

3. Being "read in" to a SAP is far more then acknowledging in writing that you have been briefed on the SAP. It is an in-depth "indoctrination" into the given SAP, and each SAP is itself compartmentalized separately from other SAPS. Having access to one SAP does not give you access to another SAP, and in fact rarely does. Only a tiny handful of people have knowledge of all SAP's. SAP's are the most stringently compartmentalized and protected information in the entire US government.

4. Unlike Top Secret SCI which is maintained in highly secure Sensitive Compartmented Information Facilitates (SCIF's) managed by specially trained Special Security Officers (SSO's) at various levels of command, every single SAP is managed by an individually designated Program Manager for each individual SAP covering an entire theater of operations. In other words, SAP Program Managers are far fewer in number than there are SSO's. SSO's are not cleared to even know about SAP's or to maintain information about them in their already enormously secure SCIF's. How SAP's are secured cannot be discussed because of the sensitive beyond Top Secret nature in which it is done.

5. Unlike individuals with the highest Top Secret SCI access security clearances, who must undergo a special background information with periodic "bring-up" background investigation, those tiny few who have access to SAP's must also endure periodic polygraph tests in addition to the most comprehensive of special background investigations. I used to have to schedule four-star generals and admirals to be polygraphed in order for them to maintain their access to my SAP. Many generals and admirals who obviously have the highest security clearances still did not rate being indoctrinated into my SAP. In fact, they didn't even know the SAP existed.

6. Compromise of a SAP is the single most dangerous security violation that can ever happen to the USA. Even the enormously damaging revelations of the Edward Snowden's TOP Secret SCI security compromise do not reach the level of an SAP compromise.

7. To put SAP information into an unsecure server like Hillary Clinton's unsecure server is a Class One Felony that could, in some cases, result in life in prison. That is because such a compromise is so dangerous that it could and likely will result in the death of people protected by and within the scope of the SAP.

As a former SAP Program Manager I believe it is inconceivable, if it is verified that Hillary Clinton's server actually had SAP information on it, that she could possibly escape indictment and criminal prosecution. As hard as it is to imagine, that would even be worse then electing to not prosecute a mass murdering serial killer because even they could not inflict as much damage on our country as the compromise of a SAP. Compromise of a SAP not only could -- but without doubt would -- cause serious damage to our national security.

If it is true that Hillary Clinton had SAP information on her unsecure server, whether it was marked or not, you can be sure that the FBI will strongly recommend that charges be brought against Hillary Clinton and continue in an exhaustive investigation to trace back to every single person that had even the tiniest role in this unbelievable security compromise.

If the Attorney General, through "prosecutorial discretion," elected not to prosecute this crime, I believe Congress would have no alternative but to impeach her, and the FBI would then have no choice but to conduct a criminal investigation of her for a deliberate cover up –- so grave is this security violation.

If President Obama were to pardon Hillary Clinton for a compromise of this magnitude he would render himself in the historical record as an "enemy of the state," and could himself face criminal prosecution –- so grave is such a security compromise. Nobody, not even the POTUS, could gets away with something like this in our system of government. If anyone could escape prosecution for compromising a SAP, we are in very deep trouble as a nation. No president who loves this country and is true to his oath would ever allow anyone, not even his or her closest and most loved relative, to get away with a SAP compromise. It is simply unimaginable that this could ever happen.

If the ongoing investigation finds that Hillary Clinton compromised a SAP, then we all should know with certainty, regardless of political persuasion, that she is entirely unfit to hold public office of any kind let alone President of the USA -- and ALL Americans should never tolerate it. Compromising a SAP is an absolute "disqualifier" for public office and access to our nations most sensitive information - period.

***Yes we are...VERY deep.***

She will be if Rafael Cruz is her opponent which no one likes. He will not pull one vote across party lines and if that be true and it is, the stupid white, black and latinos are a shoe in for her.

No one can beat her except that crazy bastard Donald Trump. He can and will pull from all lines. That is the truth.

The Clinton foundation has already been subpoenaed. Could multiple indictments be coming? The emails and quid pro quo transactions with the CF? Could Bill also be a target, not just Hillary?

What do the legal minds here think?

Judge Napolitano: ‘The FBI Now Has Leverage’ With Hillary’s Aides Who Could Be Indicted

Judge Napolitano: ‘The FBI Now Has Leverage’ With Hillary’s Aides Who Could Be Indicted

Via Daily Caller:

Judge Andrew Napolitano said Thursday that “the FBI now has leverage” in the investigation into Hillary Clinton’s private email server and can indict Clinton’s top aides and trade less punishment for testimony against her.

Citing the report by Fox News’s Catherine Herridge and Pamela K. Browne, Napolitano said on Fox News’s “America’s Newsroom” that “Mrs. Clinton’s top aides regularly received from Mrs. Clinton via her private server Top Secret emails. These are emails which the aides lacked the security clearance to receive.”

“So this tells us a couple things,” Napolitano said. “One, Mrs. Clinton was so reckless in the manner in which she sent out Top Secret emails, knowingly sending them to people who weren’t authorized to receive them.”

“We know two, their acceptance, discussion and transfer of this is a felony. We know three, that the FBI now has leverage. The Justice Department can indict her top aides and trade with them,” Napolitano said. “What would they want? Testimony against Mrs. Clinton in return for a deal with them. This is the way the government works.”

Don't be surprised if Sanders has a sudden heart attack or a massive stroke in the near future. The Clinton's have a long list of mysterious deaths associated with their activities.

I hope the FBI do not recommend indictment until Obama's exit, if a republican is elected. No way for a pardon then. I hope he does recommend if she receives the nomination.

EXCLUSIVE: Hillary Clinton And Cheryl Mills Did Not Sign Mandatory Agreement to Return Classified Materials

Any "normal" citizen in this country would be under indictment or in jail had they the same record that Hillary has when it comes to rules, regulations, and law.

And the head of the DO(in)J stands as a bulwark of protection and is being considered for SCOTUS?

Beyond the Twilite Zone.
