Federal Court Allows Challenge To Proceed Against Illinois Foster Parent Rules

BELLEVUE, WA - A federal district court judge in Illinois has denied that state's motion to dismiss a legal challenge by the Second Amendment Foundation of its foster parenting rules that place restrictions on the possession of firearms for personal protection.

SAF filed the lawsuit last summer on behalf of Kenneth and Colleen Shults in U.S. District Court for the Central District of Illinois. Named as a defendant in the case is George H. Sheldon, in his official capacity as director of the Illinois Department of Children and Family Services (IDCFS). SAF is joined by the Illinois State Rifle Association.

On Tuesday, District Judge Colin Stirling Bruce ruled that there are "sufficient factual allegations to state a claim to relief that is plausible on its face." The complaint alleges that the state has deprived the Kenneth and Colleen Shults of their civil rights under color of law.

"We brought this action on behalf of the plaintiffs to establish that the state's restrictions on the possession and carrying of firearms by foster parents is unconstitutional under both the Second and Fourteenth amendments," said SAF founder and Executive Vice President Alan M. Gottlieb. "We're delighted that the judge will allow our action to go forward because it is important to establish that people do not surrender their Second Amendment rights in order to become foster parents. We're in court to make sure that the state cannot discriminate against foster parents who merely wish to exercise the rights we've restored in Illinois."

The case now enters the discovery phase, according to SAF attorney David Sigale of Glen Ellyn, Illinois.

The case is known as Shults et al v. Sheldon.

The Second Amendment Foundation (www.saf.org) is the nation's oldest and largest tax-exempt education, research, publishing and legal action group focusing on the Constitutional right and heritage to privately own and possess firearms. Founded in 1974, The Foundation has grown to more than 650,000 members and supporters and conducts many programs designed to better inform the public about the consequences of gun control.

I'm amazed that this even had to be brought as a case in the first place. This is akin to them saying that if you are black you cannot be a foster parent.

What's next, them asking if we voted for Trump?

And the unintended consequences could be less people wanting to be a foster parent if it means surrendering their 2 amendment rights. The kids lose. Assuming the ratio's in Ill are similar to nationwide counts, ~60% are of latino or african american decent (see link). Great Policy Dem's . Sacrifice your kids and rights to further a flawed political agenda.

Insanity. Its like punishing parents who use car seats, life jackets or have a first aid kit handy. Except worse since none of those are inaliable rights.

I would bet money that they do not deny a couple of guys who want to be foster parents for a young boy....... they would see that as a Constitutional Right. Liberals cherry pick rights and who they apply to so as to fit their agendas.....

Glunt, personal property protection is in Section 1 of the 14th Amendment.

. So car seats, life jackets, and first aid kits, and any other property you have are protected.
