Background checks are unconstitutional.

- They violate the 1st Amendment because they compel people to speak and provide information about themselves.

- They violate the right against self-incrimination under the 5th Amendment because you have to provide evidence against yourself in order to acquire a gun.

- They also violate the 10th Amendment because the requirement to provide this information to the federal government is not explicitly stated as one of its powers in the Constitution.

This will be an interesting thread if it gets going.

then so is showing your ID when you board a plane.

How about when you must show ID and proof of residency to either register for or to actually vote?

You don't have to present evidence against yourself. They check the files to see if the cops have any stuff on you. Now with computers it takes less than 2 minutes if you have a clean record.

There was a time when we didn't really need them.

This is not that time...

My brother got into the Soverign Citizen thing. No liscense for car, no tags, no insurance, ect. I had to cash his checks, The police stopped him every time they noticed no license plates. The judge told him to shut up when he pled his constitutional rights. I bailed him and his wife out of jail . He finally found out that in the so called free country that what I said was true. We are allowed to live under the illusion of freedom. Few can actually be free and only when they attempt to or are forced to avail themselves to society. Things like working for a paycheck, buying groceries and simply going into a town for any reason land you in the pokey. He now has a drivers liscense, insurance ect.

God bless, Steve

Even though we live under the illusion of freedom, most in the world would give it all to live here.

We dont realize in this country that we are not truely free.

No, we're not as bad as Red China or some other countries but we are far from what the founders intended. When I have to pay a tax to keep my property ot my vehicle, and when judges totally ignore my rights and treat me like I'm guilty until proven innocent...I'm not truely free.

Sovereign Citizen... Ha... what a load of crap. They don't want to put a plate on their car and get a drivers license. They say they don't recognize the government of the U.S.,,,, But then they want to sue the Police for U.S. Dollars for arresting them.....

BTW, I love this country and wouldn't want to live anywhere else...but we have escalated the last 100 yrs towarda a Socialist/Marxist form of government.

Dems and Repubs have chipped away at our rights. Sadly, there's enough people in this country ignorant enough to vote for people that push this Socialist agenda.

I am an anarchist, common sense laws are necessary.

When entering a courthouse or airport it's common sense to check for weapons or bombs.

Drug question falls under the 5th Amendment. Self Incrimination.....

"When I have to pay a tax to keep my property"

That right there is a biggy for me. We do not own property. We don't. We pay tribute to a local government and local school district for the property we rent. That is NOT what the FF had in mind when they started this experiment.

From: TGbow

Bowbender, the majority of Americans don't realize that fact.

I think the FF would croak if they could see us today.

Been to the Wanenmacher Gun Show, Tulsa,Ok. several times and was amazed with no background checks, just have to say that you are a 'citizen' deal done. Some of the characters that were there looked like they need a background check, but it is Oklahoma not to offend the Okies. The state that use to not serve beer after mid-night and only could drink hard liquor after midnight or couldn't buy cold beer in the liquor shop may explain it better.

The constitution does not specificly spell out every issue but the principal is there.

Example: The constitution does not mention the issue of abortion but the principal is there none the less. The right to Life, Liberty and the pursuit of happiness.

The problem we've had for the last 100 yrs is that congress and the Supreme Court has over stepped their boundaries..big time.

Forcing me to speak is violating my freedom of speech because it allows for government retaliation. The first protects me against retaliation because of my speech.

If you incriminate yourself you can be charged with a crime, then you may charged in a criminal case. Thus self incrimination.

Background checks are up to the "states" and there should be no federal database.

There seems to be a misconception that there were no property taxes when the founders were alive.

"I think the FF would croak if they could see us today."

"By 1796, state and local governments in fourteen of the fifteen states taxed land. Delaware did not tax property, but rather the income from it."

HA/KS's Link
"When the Revolutionary War began, the colonies had well-developed tax systems that made a war against the world’s leading military power thinkable. The tax structure varied from colony to colony, but five kinds of taxes were widely used. Capitation (poll) taxes were levied at a fixed rate on all adult males and sometimes on slaves. Property taxes were usually specific taxes levied at fixed rates on enumerated items, but sometimes items were taxed according to value. Faculty taxes were levied on the faculty or earning capacity of persons following certain trades or having certain skills. Tariffs (imposts) were levied on goods imported or exported and excises were levied on consumption goods, especially liquor."

Not sure why it states five types of tax and only lists four.

"During the war colonial tax rates increased several fold and taxation became a matter of heated debate and some violence. Settlers far from markets complained that taxing land on a per-acre basis was unfair and demanded that property taxation be based on value. In the southern colonies light land taxes and heavy poll taxes favored wealthy landowners. In some cases, changes in the tax system caused the wealthy to complain. In New York wealthy leaders saw the excess profits tax, which had been levied on war profits, as a dangerous example of “leveling tendencies.” Owners of intangible property in New Jersey saw the tax on intangible property in a similar light."

I never said they had no taxes. There was a struggle even back then between the little n big gov politicians. But we have come a long way when 50% of what you make is extorted and if you dont pay you go jail.

Just because there are laws on the books dont make it right or moral.

When I work my butt off and a large part of my money is extorted and then redistributed to lazy folks or some gov waste machine...Id say we have a problem.

I was referring to those of us that actually work and pay taxes.
