AG Sessions Helping Immigration Courts End ‘Catch-And-Release’
Attorney General Jeff Sessions is streamlining courtroom reviews of migrants’ asylum pleas, so helping reduce the “catch-and-release” inflow of Central American migrants.
The nation’s immigration courts are run by the AG, so Sessions has the legal authority to set precedents, procedures and rules for judges and for the Board of Immigration Appeals.
On March 5, Sessions formally vacated a 2014 immigration-court decision, dubbed “Matter of E-F-H-L,” and told the 350 immigration-court judges that they could rely on submitted written evidence to avoid full hearings in some deportation cases.
“It is a big decision … the judges can use a truncated procedure to dispose of a claim that isn’t legally valid or isn’t legally meritorious,” said Art Arthur, a former immigration judge and an expert at the D.C.-based Center for Immigration Studies.
The faster process will help the judges whittle down the huge backlog of roughly 660,000 immigration-court cases, he said.
Once the backlog is minimized, all future asylum-seeking migrants can be held in detention until their cases are heard. That option will allow officials to end the “catch and release” policy which now allows many migrants through the border and into the U.S. jobs market...

Although the “vast majority” of situations are decided quickly, in hard cases federal law authorizes detaining aliens during immigration proceedings.
Alejandro Rodriguez is a Mexican who was in the U.S. legally until he was convicted for drugs and theft in 2004. His lawyers argued that he should not be deported. Although he could leave the United States at any time if he agreed to deportation, he has been in custody since 2004 because he is contesting the deportation process.
He brought this case not only for himself, but for all other aliens in a similar situation. The lower court certified the case as a class action. (more at link)
And while it may take time, most rational (i.e., not proregressive socialist) legal experts see that Sessions filings against California WRT their hindrance of ICE will succeed when it reaches the Supreme Court.
Federal Judge Allows Trump To Withhold Grants To California As Part Of Sanctuary City Crackdown

A federal judge in Northern California has declined a request from California Attorney General Xavier Becerra to block the Trump administration’s decision to withhold a law enforcement grant to the state as part of its crackdown on states and jurisdictions that protect illegal immigrants.
Becerra asked for a preliminary injunction against the Trump administration’s decision, but Judge William Orrick of the U.S. District Court for the Northern District of California ruled against taking that step.
“The injury threatened is not irreparable,” Orrick wrote. “The amount of money at stake is small compared to the state’s budget. Payment is delayed, for the moment. The DOJ appears to be using its regular administrative process to decide whether it will follow its initial inclinations.”
The judge said at some point in the future, the case “may help define the contours of the state’s broad constitutional police powers under the Tenth Amendment and the federal government’s ‘broad, undoubted power over the subject of immigration and the status of aliens.’” (continued at link)

Arizona had decided that since the Obama Administration refused to enforce immigration laws, they would do it for them.
Naturally, the Obama Justice Department sued the state of Arizona. And the case made it all the way to the Supreme Court.
The outcome was not good for Arizona.
SCOTUS ruled that when it comes to immigration laws, the Executive branch has plenary power and states have no business getting in the way.
Well, here we are in 2018 and the state of California has declared itself a Sanctuary State – effectively obstructing the Executive branch’s enforcement of immigration law.
Naturally, the Trump Justice Department is suing California over its sanctuary policy.
But thanks to Obama suing Arizona, we now know that the Executive branch has plenary power when it comes to the enforcement of immigration laws.
In other words, California is screwed.
