When stopped he driver attempts to be somewhat obnoxious and ignores the demands of the LEO - Warden, This can only go on so long! Law Enforcement sets the "tone" for each traffic stop and it's not done by the driver.
You are required under law to identify yourself to LE when it is alleged that you have violated a law, be it civil or criminal in nature. Your failure to do so will most likely land u in jail!
Our warden here, was able to summon the back up of several deputy sheriff's, who also tried to talk sense to the driver without success.
This time the doors to the vehicle were unlocked and Officers made entry and subsequently withdrew the offender who subsequently resisted arrest, The subject was placed under arrest, handcuffed and moved to a Sheriff's car for transport,
Now, everything so far with this suspect is a "civil" forfeiture and nothing criminal. Can a LEO "arrest" and handcuff a person on a civil forfeiture in WI? Absolutely.
The subject vehicle was towed (an open can of "Bud" was removed) and the offender was transported to Jail.
As the "offender" appeared intoxicated and refused "field testing" subject was subsequently arrested and processed for OWI. Subject cited under "JOHN DOE". As the subject refused to identify himself he was remanded to the Jail by the Circuit Judge until such time he identified himself or jail records would ID him.
It looks like Crusader again, was able to figure this one out. Of course, we would NOT want to fight or beat anyone - and yes, hopefully they surrender peacefully!
